Welcome to CA Agency Law, Part II. To recap, Part I was an overview of federal, state and NCAA regulations that apply to sports agents. We also reviewed current sports agency trends.
In Part II, we’ll now focus on CA Agency Law specifics - definitions, disclosures, representation of pro athletes, contract requirements, “Name, Image & Likeness” changes, protection of college athletes & universities, and civil & criminal penalties for bad acts. We’ll also introduce NFL agency requirements (Athlete-Agent & Player-Team Contracts).
And finally. We need stories. Stories about ties to organized crime, illicit payments, self-dealing, hiding assets in the Cayman Islands, collusion & extortion. Sports agency is hyper-competitive. To reinforce the stakes involved, in Part II we discuss several notorious incidents of sports agent “bad behavior.” Stories are sticky. And applying these stories is how we as lawyers show clients concrete examples of the penalties for crossing the ethical and fiduciary bright-line in pursuit of a big commission.
