About This Course
The CLE course will cover various topics related to the challenges presented in Multi-Party Construction Litigation cases.
In mediation, we will discuss how best to prepare a client/carrier for mediation and strategies for use of documents. We will also examine how a well drafted mediation statement can prepare the mediator for the challenges that this particular matter presents. We will also discuss strategies in making offers of settlement, including some hybrid options for money and work to be supervised or performed.
With respect to arbitration, we will discuss the various contracts and the types of arbitration clauses typically present. We will go through how to choose an arbitrator for the panel and how the limited discovery will affect the trial strategies of the participants. We will finally discuss how best to utilize expert witnesses and prepare for trial before the panel.
