This CLE examines the ethical issues that arise when attorneys are performing legal services on a pro bono basis. Using the ABA Model Rules of Professional Conduct, it identifies particular rules that would apply in common pro bono scenarios, and discusses how attorneys can spot potential issues and avoid “steeping over” ethical lines while they seek to effectively represent their clients and increase access to justice through their pro bono work. Some Michigan and other state bar variations from the Model Rules will also be highlighted

The CLE covers the issue of attorney competence, and in particular, how attorneys can make sure that they are competent when they venture outside of their everyday practice areas to serve pro bono clients in areas of greater legal need. It addresses the confidentiality requirement, and conflicts of interest that arise in pro bono representation, including special rules that make some accommodation for pro bono work. It examines special issues around client competency, which can arise more often in pro bono representation, special issues in advocacy, and withdrawal of representation.

The program, taught by an attorney with many years of experience in pro bono and non-profit legal services, will be interactive, encouraging audience participation and discussion.
