About This Course
With decisions pending in two class action cases Alston & Jenkins, in the District Court for the Northern District of California, that go to the heart of compensating collegiate athletes, the fundamental moorings of intercollegiate athletics could be set to undergo significant changes. This CLE course looks both the current antitrust litigation that could change the financial model of intercollegiate athletics for decades to come and the major legal issues that challenge universities and their athletic departments on campuses across the nation, on a daily basis, including: identifying Title IX issues regarding both gender equity and sexual violence, including how the newly-issued Department of Education guidance may play into intercollegiate athletics; approaching student conduct and behavior challenges on campus; procedures for reporting and investigating coaching abuse and due process standards for these actions; establishing and maintaining sports medical independence for the care of student-athletes and the appropriate oversight of healthcare providers; procedures for investigating adjudicating these issues; models for maintaining institutional and athletic integrity.
